Are they violating my trademark? Could I win?

There is a trademark violation, however since your trademark is not registered..approval means nothing legally..there is not much you can do about it. Your trademark would have to be in the public eye for a while. Trademark searchs don't even take place anymore..so the other company might have registered it first. The only thing you can do is to contact the trademark office and notify them of this, they might send a notice to the other company to cease using that name. Good luck. PS..also copyright the name..it is very inexpensive.
